In November 2020, South Dakota (SD) voters passed a ballot measure to legalize adult use of cannabis. The State took issue with the ballot measure making a technical argument that the ballot initiative violated the state's requirement that constitutional amendments deal with just one subject. The SD Supreme Court has ruled in favor of the state so advocates will need to return with a new ballot initiative to legalize adult use in an upcoming election.
